Tennessee requires a minimum waiting period of sixty (60) days from the day the divorce complaint is filed if there are no minor children involved. If there are minor children involved, Tennessee requires a minimum waiting period of ninety (90) days from the day the divorce complaint is filed. If you and your spouse agree on a Marital Dissolution Agreement and a Parenting Plan during that window, the divorce can be granted once the waiting period has expired. However, if you are unable to work everything out with your spouse, it can take much longer, depending on the court that your case is in.
